Into the Bush league

For years, Canada has worked with a simple concept: when someone accused of a crime meets with their lawyers, police and the justice system cannot listen in to the conversation and then use that discussion as evidence.

It's a precedent that has particular history in this province. After drugs were found at Ireland's Eye and charges were laid against alleged organized crime boss Vito Rizzuto, police went looking for extra evidence and bugged a table lamp used by lawyers for the accused.

When the bugged lamp was discovered, Judge Leo Barry threw the charges out of court. When lawyers talk to clients, they have a reasonable expectation of privacy, and their discussions are privileged.

It's such a strongly held precept that, like the Ireland's Eye case, otherwise strong cases are thrown out when such a transgression is discovered.

Last Thursday, lawyers for Canadian terrorism suspects discovered that same expectation was not in place for them, and that, using the foggy legal world of Canadian security certificate rules, agents from the Canadian Security and Intelligence Service (CSIS) had been recording and listening to their calls.

What they were finding on those calls must not have been particularly valuable to CSIS. After all, as soon as lawyers for the terrorism suspects found out their conversations were included in the wiretapping, CSIS agreed to stop doing it.

Which, of course, makes you wonder, in the first instance, why they were doing it at all, and second, whether they would have stopped if they hadn't been caught red-handed.

It also makes you wonder just what else our security services might be doing under the guise of protecting us from terrorism.

One of the hallmarks of the Canadian justice system is its openness: read enough court cases, and you would be startled at the number of times that cases are thrown out of court because straightforward rules of evidence and procedure are broken.

The cases are thrown out to maintain Canadians' confidence in the impartiality and fairness of the justice system. Those rights should extend to anyone accused of a crime because, as has always been the case in this country, you are innocent until proven guilty. And that proof comes in a court of law, not from the suspicions, however well-documented, of a clandestine security force.

Our neighbours to the south seem to have decided that the ends always justify the means, and that there is a place for secret trials, waterboarding, and cases in which evidence against suspects is deemed too top secret to even be revealed to those who are being tried.

Some of those steps - secret trials and secret evidence - have found their way into the formerly open Canadian justice system as well, to the detriment of us all. To the extent that we have followed the Americans in that direction, we have clearly made a wrong turn.
